Cher partenaire marchand,
Une nouvelle réglementation européenne1 entre en application au 1er juillet de cette année, relative notamment à la collecte de la TVA par les Marketplaces à la place des marchands.
Le principe général est que notre Marketplace devient responsable de la collecte, du reporting auprès de l’administration et des douanes et du reversement de la TVA à la place des marchands, dans certaines conditions. |

Quelles sont ces conditions ?
|
|
Si le marchand a son siège social dans l’Union Européenne ET si le marchand expédie la commande depuis l’extérieur de l’UE => Rue du Commerce va collecter la TVA sur la commande
Si le marchand a son siège social en dehors de l’Union Européenne => Rue du Commerce va collecter la TVA sur la commande dans tous les cas, qu’il expédie ou non depuis l’UE
Les marchands français et enregistrés dans l’Union Européenne qui expédient uniquement depuis la France ou l’Union Européenne ne sont donc pas concernés.
Ainsi, les conditions d’application s’apprécient selon chaque commande, qui sera analysée individuellement. |

Exemples :
Un marchand enregistré en France qui livre depuis un stock au Brésil => Rue du Commerce va collecter la TVA.
Le même marchand qui est en rupture sur son stock au Brésil et qui livre depuis son stock en Allemagne => Rue du Commerce ne va pas collecter la TVA.
Un marchand Chinois, établi à Hong Kong, qui livre depuis son stock en Chine => Rue du Commerce va collecter la TVA.
Un marchand Chinois, établi à Hong Kong, qui livre depuis son stock en Allemagne => Rue du Commerce va collecter la TVA.
Un marchand Allemand, qui livre depuis son stock en Allemagne => Rue du Commerce ne va pas collecter la TVA

Quelles conséquences opérationnelles ? |
|
Nous connaissons déjà le lieu d’enregistrement de votre société dans Mirakl et nous allons à présent devoir connaître le lieu d’expédition de vos commandes. Pour cela vous devrez renseigner certains champs dans Mirakl.
Dans votre boutique, obligatoirement

Pays de résidence du marchand : déjà renseigné dans la rubrique Coordonnées
|
|
|
Pays d’expédition des offres par défaut : à renseigner. |
|
|
Pour un marchand Français ou de l’Union Européenne qui expédie uniquement depuis la France ou l’Union Européenne, il n’y a donc rien d’autre à faire que de renseigner ce nouveau champ dans votre boutique.
Dans vos flux offres, si besoin
|
|
Pays d’expédition des offres : à renseigner uniquement si vos produits peuvent être expédiés depuis des pays différents de celui indiqué dans votre boutique. |
|
Dans les commandes, si besoin
|
|
Pays d’expédition des offres : ce champ sera pré-rempli lorsque nous vous enverrons vos commandes. Nous nous baserons sur le pays d’expédition par défaut présent dans votre boutique ou sur le pays d’expédition communiqué avec l’offre concernée.
Vous pourrez corriger ce nouveau champ au niveau de la commande, ce qui pourrait entrainer un recalcul des taxes à collecter. Par exemple, si votre pays d’expédition est finalement différent de celui indiqué dans la boutique ou dans l’offre.
Ainsi, lors de l’acceptation de la commande, en plus du prix et des stocks, vous pourrez contrôler le pays d’expédition. Ce champ ne sera plus modifiable après ACCEPTATION de la commande dans Mirakl. |

Ces 3 nouveaux champs sont en train d’être mis en place sur Mirakl, nous vous les présenterons précisément lors d’une prochaine communication
Hiérarchie entre les 3 champs qui portent le pays d’expédition :
Le pays notifié sur la commande est prioritaire sur le pays notifié sur l’offre qui est prioritaire sur le pays notifié dans votre boutique.

Attention, une même commande peut avoir des règles de taxation différentes. Par exemple une commande multi-produits avec des catégories différentes qui seraient soumises à des taux de TVA différents.
Afin de limiter l’impact pour les vendeurs et les agrégateurs, vous continuerez à fonctionner en prix TTC dans vos flux. C’est Rue du Commerce qui décomposera ensuite sur la commande le prix entre la part Hors Taxe et la part TVA.
Ainsi, outre nous indiquer les pays d’expédition des produits, vous ne devrez rien changer à vos flux et à vos catalogues.
Pour le dédouanement de vos produits, Rue du Commerce vous communiquera le numéro d’identification TVA et ce notamment afin d’éviter que la TVA ne soit perçue au moment de l’importation. Pour information, en France, la réception de marchandises en provenance d’un pays extérieur à l’Union européenne est soumise : |

-à la TVA (et aux autres impositions nationales) dès le premier euro;
-et aux éventuels droits de douane si la valeur de la commande est supérieure à 150 euros.

Dear merchant partner,
New European regulations1 will be formally effective on July 1 of this year, particularly concerning the VAT collection by Marketplaces instead of merchants.
The general principle is that our Marketplace becomes responsible for collecting, reporting to the administration and customs as well as paying the VAT in the place of merchants, under certain conditions.

Who will be concerned and what are the conditions? |
|
If the merchant is headquartered in the European Union AND if the orders are shipped from outside the European Union => Rue du Commerce will collect VAT on the order.
If the merchant is headquartered outside the European Union => Rue du Commerce will collect VAT on the order in all cases, whether or not he ships from the European Union.
French merchants or merchants registered in the European Union who ship only from France or the European Union are therefore not affected.
Thus, the conditions of application are assessed according to each order, which will be analyzed individually.

Examples :
A merchant registered in France delivers from stock in Brazil => Rue du Commerce will collect VAT.
The same merchant who is out of stock in Brazil delivers from his stock in Germany => Rue du Commerce will not collect VAT.

What are the operational consequences ? |
|
We already know in Mirakl where your company is registered. From now on we will need to know where your orders are shipped from. For this you will need to fill in fields in Mirakl:
In your shop, mandatorily
|
|
Country of residence of the merchant: already entered in the Contact details section |
|
|
Shipping country by default: to be entered. |
|
|
For a French or European Union merchant who ships only from France or within the European Union, there is therefore nothing else to do than fill in this new field in your shop.
In your offers feed, if necessary
|
|
Offers shipping country: to be indicated only if your products can be shipped from other countries than the one indicated in your shop. |
|
In the orders, if necessary
|
|
Offers shipping country: this field will be pre-filled when we send you your orders. We will fill this field based on the default shipping country in your shop page or the shipping country communicated with the concerned offer.
You can correct this new field at the order level, which may lead to a tax recalculation. For example, if your shipping country is ultimately different from what indicated in the shop or in the offer.
Thus, when accepting the order, in addition to the price and stocks, you will be able to control the shipping country. This field will no longer be editable after ACCEPTANCE of the order in Mirakl.

These 3 new fields are being implemented on Mirakl, we will provide further information in detail in the next coming communications.
The hierarchy among the 3 shipping country fields:
The country indicated on the order has priority over the country indicated on the offer which has priority over the country indicated in your shop.

Please note that the same order can have different tax rules. For example, a multi-product order with products from different categories would be subject to different VAT rates.
In order to limit the impact for merchants and aggregators, you will continue to indicate the price inclusive taxes (TTC) in your feeds. Rue du Commerce will take in charge the break-down of the price for the order between the part without VAT and that of the VAT. Hence, apart from informing us the countries where the orders are shipped, no additional operations will be required in your feeds and catalogs.
For the customs clearance of your products, Rue du Commerce will provide you with the VAT identification number, in particular to prevent VAT from being collected at the time of importation. For your information, in France, receipt of goods from a country outside the European Union is subject to: |

-VAT (and other national taxes) from the first euro;
-and any customs duties if the value of the order exceeds 150 €. |

至此,在您收到订单时,除了价格和库存外,您还可以调整发货地。在您在Mirakl系统中确定接受订单后,发货地项将不可再编辑。

同一个订单内可能会出现不同的税收规则。例如,一个含有多项不同品类商品的订单有可能会参考不同的VAT税率。
为了减小对卖家以及订单集成服务商的影响,在您的批量订单管理中,您只需要继续登记已含税的价格(TTC)。Rue du Commerce 电商平台将负责细分订单价格中的不含税部分及VAT部分。
因此,在批量上传中,您除了需要告知商品发货地外,无需进行其他操作。
在产品的清关过程中,Rue du Commerce 将会为您提供增值税识别号,来避免产品进口时被双重征税。
作为#x53C2;考,从欧盟以外国家/地区发至法国的包裹将履行以下条件:

进口货物增值税豁免政策将被终止。所有包裹将从第一欧元起征收增值税(及其他国家税项);
价值超过150€的包裹可能需要缴纳关税。
